Before you rely on this page

These answers come from the covenants for Sections One, Three, Four and Five, which is lots 1-77 and 79-213 and the bulk of the neighborhood. Section Two, the long lots fronting Elm Road, is expressly outside those covenants and has a recorded set of its own.

Perimeter fencing up to four feet may be allowed, with the style and location approved in writing before it goes up. Privacy fencing up to six feet is allowed only around a patio next to the house and has to match the style of that house. Fencing around a swimming pool has to meet St. Joseph County Building Department requirements and be approved in writing before construction starts.

A detached storage building or pet shelter may be no larger than 10 by 12 feet, has to be quality construction that blends with the house, and needs written approval before building starts. The committee can require screening around it.

Any alteration, improvement or remodeling that changes how the house looks from outside has to be submitted and approved in writing before work begins. Plans have to show the floor plan, quality of construction, materials, outside colors, how the design sits with the houses around it, and placement against the lot lines and grade. Side, front and rear yards have to be planted with grass seed or sod unless another ground cover is approved in writing. Grading and seeding are due by the time of occupancy, or as soon as the season allows and no later than June 15 after occupancy. None of it may hinder drainage, and drainage swales and road ditches have to be left open.

Pets

Household pets are allowed as long as they are not bred or kept commercially and do not become a nuisance. Dogs have to be leashed and kennels are not permitted. A dog exercise area needs approval of its materials and design, and if approved it may be fenced five or six feet high tight to the side or rear of the house, in split rail, invisible or vinyl-coated mesh, wood or another approved material.

Driveways must be at least twelve feet wide and made of brick or concrete, with concrete at least four inches thick. Stone and cinder driveways are not allowed, and a circular drive must be at least eight feet wide. Recreational and commercial vehicles cannot be kept in open areas, and minibikes, motorcycles, go-carts and snowmobiles may not be driven inside the subdivision. Parking on the street is not addressed.

A home occupation is allowed if it is run by a family member living in the house, stays entirely inside the dwelling, and stays clearly secondary to living there. There can be no sign, nothing sold on the premises, and nobody employed from outside the immediate family.
