Before you rely on this page
The association's own overview is candid that the 1984 declaration contains provisions aimed at the original construction and the developer's control period, before the turnover to the homeowners - so a paragraph about the Declarant's rights is history rather than a live rule. The rules stated on this page are the ones that still govern an owner. Two of the most important, the recreational vehicle ban and the requirement to repaint every six years, come from amendments rather than the original 1984 text.
No perimeter fencing of any type is permitted without the Architectural Control Committee's advance written approval - and the ban is drawn wide enough to catch planting: hedges and other growing fences are named alongside chain link and split rail.
No structure of a temporary character, trailer, basement, tent, shack, garage, barn, TOOL SHED, STORAGE SHED or other outbuilding of any type may be used on a home site at any time, temporarily or permanently. An amendment goes further still: no permanent or temporary structure other than the home itself may be placed on a home site, or attached to any surface of the home, or to a tree, bush or any other part of the landscaping, without the association's prior written approval.
An amendment made this one of the strictest in the directory. No recreational or commercial vehicle of any type - campers, trailers, trucks, boats and all-terrain vehicles are named - may be kept in open areas anywhere on the property, whether on your own home site or off it, and the ban expressly reaches parking in the streets, in driveways and anywhere else. Recreational vehicles are barred from the golf courses and surrounding areas, and snowmobiles are prohibited outright with users subject to prosecution.
No tennis courts and no above-ground pools at all. Any other swimming pool may be built only after prior written approval from the Architectural Review Committee - and installing one is also named in the paragraph requiring the Board's and the Committee's written approval for changes to the home.
An owner may not paint, decorate or make any change to the appearance of the exterior that varies from the plans the Architectural Control Committee approved, without the prior written approval of BOTH the Board of Directors and the Committee. The paragraph names what that covers: sidewalks, driveways, paint colour, roof colour, additions to the home and installing a swimming pool. An amendment added a positive duty as well - the exterior that was painted when the home was built must be repainted at least once every SIX years, using paint and a colour the association approves and to a standard of workmanship it finds satisfactory. Awnings need Architectural Review Committee approval. Driveways must be at least twelve feet wide and asphalt or concrete - no stone or cinder - with asphalt three inches thick and concrete four, and all fireplace chimneys are masonry.
No outside above-ground television, AM, FM or short-wave radio antenna of any type may be erected or maintained on any home site or structure here, and all utility service is underground and out of sight. The declaration dates from 1984 and does not carve out a small satellite dish the way later ones do; federal rules have since limited how far a covenant like this can be enforced against one, so ask the Committee before assuming either way.

The association runs the irrigation system on every home site and decides how often it waters, though the owner pays for the water used - even where it reaches an adjoining lawn. Trees are split by trunk size: under twelve inches across is the association's to maintain, twelve inches or more is yours to prune and to remove when dead, unsightly or dangerous, and if the association has to step in it bills you as an additional common expense.

You cannot simply let a villa here. No lease may be entered into at all without the association's prior approval, and no lease may run for less than one year. Plan on both if you are buying this as a rental.
Basketball hoops and backboards are named outright in the amendment that bans placing any structure other than the home on a home site, or attaching anything to the home, a tree, a bush or the landscaping, without the association's prior written approval - nets and birdhouses are on the same list. The same amendment bars leaving athletic equipment or paraphernalia on a home site at all, and it names trampolines, swings, decorative tires, plastic flamingoes, sun balls and nets.
No sign of any kind may be displayed to public view on a home site, except one sign of no more than five square feet advertising the property for sale or rent, and a builder's sign of any size during the construction and sales period.
Ordinary cars are fine; almost nothing else is. The amended vehicle rule bans keeping any recreational or commercial vehicle - camper, trailer, truck, boat or all-terrain vehicle - in an open area anywhere on the property, and says expressly that this includes parking in the streets and in driveways as well as on your own lot. Driveways must be at least twelve feet wide and paved in asphalt or concrete.
